Marijuana Possession Penalties in Virginia -- First Offense

A person convicted of possessing marijuana for the first time has a good  chance of not getting jail time.

Virginia does not treat marijuana possession as a "slap on the wrist" offense -- it is a Class 1 misdemeanor with a maximum jail term of 1 year, plus a $2,500 fine, and loss of driver's license for a year.

However, certain cases bear more leniency.

A "first-timer" may be eligible for "first offender stautus." 

Attorneys who specialize in drug offenses may be able to obtain for their clients the benefits of this statute.
