Father Excused From Transporting Child to New York for Visitation

Father of 6 year boy who moved to Virginia from New York sought to amend New York Court Order requiring him to transport child to New York twice monthly for visitation with boy's mother, who was incarcerated on state drug distribution charges there.

Evidence at the hearing was found by the court to justify it's assuming jurisdiction over the case in place of New York under the Uniform Child Custody Jurisdiction Act. Recognizing that the almost 8-hour one-way travel to New York from Virginia was a hardship and placed the child at risk, the court granted a temporary Order reducing the visitation from once every two weeks to once every six weeks, finding that to do so was in the child's best interests.
