A VCU graduate student charged with possession of marijuana last Spring after police peeped through his backyard fence and claimed to have seen him and a friend smoking, had his case continued by the Richmond General District Court on the Commonwealth's motion.
On the morning of trial, the Commonwealth's Attorney proposed a plea agreement whereby the student would not enter a plea, but agree to perform a few hours of community service and successfully complete a substance abuse course. The charge will be dismissed if he complies with those conditions, and does not violate any other law in the next 6 months. He did not have his driver's license suspended, as would have been the case had the Commonwealth prevailed at trial.
The proposal was triggered by a defense motion to suppress the evidence. The officers had trespassed on his property to look through the gaps of a privacy fence after smelling marijuana in the alleyway. Rather than obtain a search warrant, the officers opened the fence gate and came into the student's backyard, where he and and his friend were sitting on the rear deck, and arrested him, and seized the remnants of a recently smoked joint.
