Virginia Use of Firearm Charge Dismissed at Preliminary Hearing

Client was charged with use of a firearm in the commission of a felony. This is a separate offense punishable by a mandatory minimum sentence of 3 years in prison.

At the conclusion of the Commonwealth's evidence at the preliminary hearing, the defense moved to dismiss both charges for failure to produce sufficient evidence to sustain them. The court granted the motion on the "use of firearm" charge," but denied it as to the underlying charge. Subsequently, the Commonwealth withdrew the underlying charge.
