Are there ANY defenses to a BAC above the legal limit?
A: That depends on the individual. It is not against the law in VIrginia to drive after consuming alcohol. However, it is illegal to drive with your BAC is at 0.08 or higher, or when you are impaired by alcohol or drugs. Because the alcohol absorption rate for individuals varies depending on a number of factors, a person testing at 0.10 may have been operating his car or truck an hour earlier when he was stopped within the legal limit of 0.07, or lower.
