Does Virginia law require me to take the Field Sobriety Tests if the officer asks me to do them?
A: No, Virginia law does not require you to take the Field Sobriety Tests if you are stopped and the officer suspects you are impaired.
Field Sobriety Tests are not necessarily reliable indicators of impairment. Many studies have completely discredited their value to law enforcement, except that they can form the basis of probable cause to arrest for DUI.
