Absolutely!! You don't want something like this to show up when you apply for a job, do you? And there are defenses available to you if things happened as you said.  Unless the arresting officer actually observed you in possession of the beer, that is, holding or drinking it, you should not have been charged. Once the beer was ingested, you cannot control the situation and cannot be convicted of possession.

I am a 19 year old sophomore at JMU. I attended a keg partyand had a few cups of beer during the night, but waited an hour or more after my last drink before leaving so I could sober up before heading to the dorm. There were three of us in the group Iwas walking homewith and the other two were pretty drunk -- obviously! Campus police saw my friends stumbling, and came over to us and after smelling beer on our breath, arrested all us for underage possession of alcohol. Do I need a lawyer?
