Q: I was test-driving a BMW in Richmond. Soon after leaving the dealer's lot another driver ran a stop sign and T-boned the BMW. I was hurt pretty bad. My hospital bills are already over $100,000, and I will likely miss 6 months of work. My lawyer said the other driver had minimum liabilty limits of $25,000 on his insurance policy, but that won't be enough to even cover my medical costs. Am I stuck?
A: Maybe not. The dealer is required to have liabilty insurance coverage on each of the cars on the lot. This is commonly referred to as a "garage policy." The garage policy should also contain Uninsured/Underinsured Motorist (UM/UIM) coverage provisions to protect anyone injured while operating the dealer's cars if the party at fault has no insurance (UM Coverage) or liability insurance that is not enough to pay for personal injuries another may sustain in an accident (UIM Coverage).
Additionally, your lawyer should already have determined what your auto policy UM/UIM limits are, as they may be a source of additional coverage to compensate you.
