Persons previously convicted of possession or distribution of crack cocaine are eleigible to have their federal sentences reduced effective November 1, 2011.

Reduction in Term of Imprisonment for Crack Cocaine Convictions Are in Effect

Amendments to the federal sentencing guidelines for persons convicted of drug possession and distribution of crack cocaine (cocaine base) were approved in July by the U.S. Sentencing Commission (USSG). It provided for a 2-point reduction in the base sentencing guideline, and was made retroactive to benefit those convicted of crack cocaine-related charges who already are serving time in prison.

The effective date of the amendment is November 1, 2011.

This amendment will affect the prison sentences of thousands of federal inmates. Many will be eligible for immediate release.

If so, the attorney needs to file a motion with the sentencing court to apply the new guidelines amendment and recalculate the sentence to serve.
