What We've Been Saying! Former policeman attacks procedures in DUI arrest!
Field Sobriety Tests (FSTs) have been proven to be unreliable indicators of driver impairment, though most people do not know this. Find out what you should know before deciding whether to do them or not.
From news reports:
Arlington County police say Alexandria Chief of Police David P. Baker is facing a drunken driving charge following an accident in which a driver was injured. Arlington police say Baker was arrested about 11 p.m. Saturday following the accident in Arlington.
Police say the driver of the other car sustained non life-threatening injuries and was taken to a local hospital. Police say Baker, who was driving an unmarked city vehicle, registered a .19 blood alcohol level and was released after booking.
If convicted of the offense as charged, Mr. Baker faces a mandatory minimum sentence of 5 days in jail. Under Virginia's DUI laws, even a first time offender must be jailed if the evidence establishes that his Blood Alcohol COncentration (BAC) was between 0.15 and 0.19.
While Alexandria officials have placed Baker on administrative leave, no one is willing to opine at this time whether the incident will result in Baker's dismissal as police chief, a position he has held for the past 3 years. Baker has been with the department for more than 20 years.
Baker has reportedly hired an attorney and it is expected he will mount an agressive defense to the charges.
