Performing Field Sobriety Tests (FSTs) when you are stopped for suspicion of DUI / DWI may not be in your best interests, and could ruin your chances of getting a favorable outcome in court after you are charged. Richmond, VA, Reckless Driving Attorney, Virginia DUI attorney

Field Sobriety Tests (FSTs) have been proven to be unreliable indicators of driver impairment, though most people do not know this. Find out what you should know before deciding whether to do them or not.

Almost every time a person is stopped for suspicion of DUI/DWI, the officer requests that the driver perform a series of Field Sobriety Tests (FSTs). These are intended to allow the officer to build up more probable cause to charge you with driving while impaired, rather than establish that you are not impaired.

In Virginia, these tests are voluntary -- you can refuse to perform them.

You may want to refuse if asked. The tests are so subjective that they are unreliable indicators of impairment, as was shown in a study done at Clemson University in 1994.
