The man was senteneced to 21 years in the death, but the judge suspended 17 and one-half years. The 53 year old victim had stopped at the convenience store late in the evening to pick up some items before going to babysit her daughter's children, and was crushed between the side of the building and the defendant's minivan when the vehicle jumped the curb. A State medical expert estimated the defendant's blood alcohol level at two to three times the legal limit at the time of the accident.
