Virginia DUI Checkpoint Acquital Reversed

The Virginia Court of Appeals held that a sobriety checkpoint was properly administered and reversed the trial court's order suppressing evidence necessary to convict a driver of DUI. The Commonwealth appealed the trial court's ruling that the checkpoint was faulty because the patrol supervisor had too much discretion in organizing and operating it.
